The major purpose of criminal law is anticipation and punishment, whereas the purpose of civil law is individual reimbursement. Criminal offenses have two distinct elements one is the physical act and the other is the requisite mental state act. Criminal law neither requires a victim’s consent, or a victim, or a prosecute for an offender. Moreover, a criminal prosecution can happen over the objections of the victim as well as the consent of the victim. This is not a defense in most of the crimes.
